Laguna Beach Court Process

The Laguna Beach DUI process generally begins when you are cited for DUI and provided a citation with a date to appear in Court. The Laguna Beach police officer will then forward the arrest report to the Office of the Orange County District Attorney (OCDA). A charging deputy from the OCDA will then examine the report and decide whether or not to file a complaint against you in Court. In most cases a Laguna Beach DUI is filed as a misdemeanor, which means your Laguna Beach DUI attorney can appear on your behalf at the Harbor Justice Center without you being present.

The first date to appear in Court is referred to as the arraignment. During the arraignment stage of the Court process, the charges on the complaint against you are presented and a plea of “guilty” or “not guilty” is entered. Many times your Laguna Beach drunk driving lawyer will enter a plea of “not guilty” on your behalf and set your case for a pre-trial hearing. There are special instances, however, in which keeping your matter at the arraignment stage will result in a better outcome. If this is true in your case, your qualified Laguna Beach DUI defense attorney will simply continue your arraignment. If your case is set for a pre-trial, your skilled Laguna Beach DUI lawyer will negotiate your matter with the District Attorney. During pre-trial, your Laguna Beach DUI lawyer will examine your case to see if any pre-trial motions should be filed.

Based on the specific circumstances of your case, your skilled Laguna Beach DUI lawyer will help you determine if it is best to take a plea bargain or if you would fare better by taking your case to trial. Contact the Parker Law Center today for a free case evaluation!

Laguna Beach DMV Process

Many times when a person is arrested for a DUI in Laguna Beach, the police officer will take possession of the person’s driver’s license and provide the driver with a temporary driver’s license. This temporary license allows the driver to maintain full driving privileges for the 30 days following arrest; if the driver takes no further action the driver’s license will then become suspended. If you have been arrested for driving under the influence in Laguna Beach, you have a right to fight this license suspension by requesting an Administrative Per Se (APS) Hearing with the Irvine Driver Safety Office within 10 days of your arrest. The Irvine Driver Safety Office will then provide you with a temporary license that will allow you to maintain normal driving privileges up until you receive a decision on your APS hearing. A knowledgeable Laguna Beach DUI attorney will request this hearing for you within the first 10 days, along with discovery, and a stay on your license suspension.

An agent of the Irvine Driver Safety Officer known as a Hearing Officer will conduct the APS hearing. The Hearing Officer has the burden of proving the following issues:

If the driver submitted to a chemical test there are three issues:

  • Did the officer have reasonable cause to believe that the licensee was driving a motor vehicle in violation of California Vehicle Code Sections 23152 or 23153?
  • Was the licensee lawfully arrested?
  • Was the licensee driving a motor vehicle with 0.08% or more, by weight, of alcohol in the blood?

If a Chemical test was not taken (a refusal) the issues are:

  • Did the officer have reasonable cause to believe that the licensee was driving a motor vehicle in violation of California Vehicle Code Sections 23152 or 23153?
  • Was the licensee lawfully arrested?
  • Was the licensee advised that refusal to submit to, or failure to complete, a breath or blood test would result in a one year license suspension or two or three year revocation?
  • Did the licensee refuse to submit to, or fail to complete, a chemical test after being requested to by a peace officer?

The Hearing Officer has the responsibility of entering the documents into evidence at the APS hearing. A qualified Laguna Beach DUI attorney should have expertise in objecting to the documents, as well as, expertise in presenting opposing evidence. At the close of the hearing, the Hearing Officer takes all of the evidence under submission and makes a written decision that will be mailed to both you and your Laguna Beach DUI attorney. The APS decision can arrive within a few weeks or even a few days depending on the Hearing Officer’s schedule; the decision will either uphold the suspension or set it aside. If you or someone you love has been arrested for DUI in Laguna Beach, please contact the Parker Law Center today so we can request your APS hearing and help fight to save your license!
